Welcome to Cogsynth ("we", "us", or "our"). By accessing or using our platform at cogsynth.io, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Cogsynth, you confirm that you are at least 13 years old, have read and agree to these Terms, and have the legal capacity to enter into a binding agreement. If you are using Cogsynth on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

Cogsynth is an AI-powered app builder that allows users to generate, edit, and export web applications using large language models. The platform includes a code editor, preview environment, template library, and optional integrations with third-party AI providers.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access at support@cogsynth.io

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use Cogsynth to:

• Generate, distribute, or publish illegal, harmful, or abusive content
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, hack, or disrupt the platform
• Use automated scripts to abuse the AI generation endpoints beyond your plan limits
• Resell access to the platform without written permission

5. Intellectual Property

You retain ownership of all code and content you generate using Cogsynth. By using the platform, you grant us a limited, non-exclusive license to process your inputs and outputs solely to provide the service.

The Cogsynth platform itself, including its UI, templates, and backend systems, is our proprietary property and may not be copied or redistributed without permission.

6. API Keys and Third-Party Services

If you provide your own API keys (BYOK — Bring Your Own Key), you are responsible for their security and any costs incurred with the respective provider. We store keys server-side and do not log them, but you should rotate keys immediately if you suspect compromise.

7. Billing and Payments

Paid plans are billed monthly or annually via Stripe. You authorize us to charge your payment method on a recurring basis. Refunds are handled on a case-by-case basis — contact billing@cogsynth.io. We reserve the right to modify pricing with 30 days' notice.

8. Disclaimers

Cogsynth is provided "as is" without warranties of any kind. AI-generated code may contain errors, security vulnerabilities, or inaccuracies. You are responsible for reviewing and testing all generated code before deploying it to production. We are not liable for any damages arising from the use of AI-generated outputs.

9. Limitation of Liability

To the maximum extent permitted by law, Cogsynth's total liability to you for any claim arising from these Terms or use of the service shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

10. Termination

Either party may terminate the relationship at any time. Upon termination, your access to the platform ceases. You may export your projects before terminating. We will delete your data within 90 days of account closure upon request.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration or in the courts of Delaware.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the platform after changes constitutes acceptance.
